From 2003 to at least 2004, the firm oversaw a series of out-of-court settlements related to multiple product recalls involving NXHealth’s children’s supplements, including BOY VitaLife+ Chewable Gummies and Udder Buster. These settlements included financial compensation as well as the provision of free testing and counseling services through Growing Minds Learning Center, aimed at families of children reportedly affected by the recalled products.

In 2005, Gerber Law Group also represented NXHealth CEO Alfred Sacksman in a successful defamation lawsuit against local radio station and gossip forum 90.3 The Secret, following a series of broadcasts that questioned the role of the Sacksman family in the disappearance of Chet Sacksman. The firm’s involvement effectively suppressed further public inquiry into the matter, boosted public sympathy for the Sacksman family, and contributed to the temporary restoration of NXHealth’s reputation in the region.
